$80 Million: Grooming New Addicts?

McNEIL-PPC, Inc., in consultation with the U.S. Food and Drug Administration (FDA), voluntarily recalled all lots that have not yet expired of certain over-the-counter (OTC) Children’s and Infants’ liquid products. - Ortho-McNeil-Janssen Pharmaceutical, Inc. will pay $75.37 million to resolve civil allegations under the False Claims Act that it illegally promoted Topomax. - Ortho-McNeil Pharmaceutical, LLC, subsidiary of Johnson & Johnson pled guilty to illegal promotion of Topomax psychiatric drug; sentenced to criminal fine of $6.14 million.

US Attorney Carmen M. Ortiz said: This case should send a strong reminder that the off-label promotion of pharmaceuticals is illegal, whether it is done directly by company employees, or through programs such as the ‘Doctor for a Day Program.’ We will remain vigilant in our enforcement of these laws regardless of what form the conduct takes. Every year the gigantic drug companies come out with new and improved ways to relieve our symptoms associated with ill health.
